Terms of Service

1. Acceptance of Terms

By accessing or using LaunchShield ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. These terms constitute a legally binding agreement between you and LaunchShield.

2. Description of Service

LaunchShield is a security release gate for AI-built applications. The Service analyzes source code repositories connected via GitHub, performs automated security analysis, and provides release verdicts based on configured security policies.

3. Account Registration

To use the Service, you must:

• Be at least 18 years old or have legal capacity to enter into contracts
• Provide accurate and complete information during registration
• Maintain the security of your account credentials
• Connect a valid GitHub account with appropriate permissions
• Notify us immediately of any unauthorized use of your account

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe upon intellectual property rights of others
• Upload malicious code or security exploits
• Attempt to bypass or circumvent security measures
• Interfere with the proper functioning of the Service
• Access data or accounts you are not authorized to access

5. GitHub Integration

By connecting your GitHub account, you grant LaunchShield permission to:

• Read repository metadata and source code for analysis purposes
• Create status checks on pull requests (with your explicit permission)
• Access commit history and branch information

Source code is analyzed in ephemeral workspaces and is not stored persistently beyond the duration required to complete the analysis and generate reports.

6. Subscription and Billing

LaunchShield offers both free and paid subscription plans. By subscribing to a paid plan, you agree to:

• Pay all fees associated with your selected plan
• Provide valid payment information
• Subscriptions renew automatically unless cancelled before the renewal date
• We may modify pricing with 30 days advance notice
• You may cancel your subscription at any time from your account settings

Refund Policy: In accordance with EU consumer protection laws, you have the right to cancel your subscription within 14 days of purchase for a full refund. After this period, fees are non-refundable except in cases of service failure or as required by law. To request a refund, contact hello@launchshield.dev.

7. Intellectual Property

LaunchShield retains all rights to the Service, including software, trademarks, and content. You retain ownership of your source code and any data you upload. Analysis reports generated by the Service are licensed to you for internal use.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. While we strive to provide accurate security analysis, LaunchShield does not guarantee that all vulnerabilities will be detected. Security decisions remain your responsibility.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LaunchShield SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your access to the Service for violations of these terms. You may cancel your subscription at any time. Upon termination, your right to use the Service ceases immediately, though we may retain certain data as required by law.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms shall be instituted in the courts of Barcelona, Spain, and you consent to the exclusive jurisdiction of such courts.

EU Consumers: If you are a consumer residing in the European Union, you also benefit from any mandatory provisions of the law of the country in which you reside, and nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions.

12. Dispute Resolution

Before filing any legal claim, you agree to first contact us at hello@launchshield.dev to attempt to resolve the dispute informally. We will make good faith efforts to resolve disputes within 30 days.

13. Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and LaunchShield regarding the use of the Service, superseding any prior agreements between you and LaunchShield relating to your use of the Service.

16. Changes to Terms

We may modify these Terms from time to time. We will notify you of significant changes via email or through our platform. Continued use of the Service after changes constitutes acceptance of the updated Terms.
